This Privacy Policy explains how FleetMark LLC ("FleetMark," "we," "us") collects, uses, and protects information in connection with our websites (including myfleetmark.com and our vertical sites) and our fleet-dispatch and operations software platform (the "Service").
Protected Health Information (PHI) is handled separately. This Policy governs information for our websites and platform accounts. It does not govern Protected Health Information. Where a customer (for example, a medical-transportation operator) processes PHI through the Service, FleetMark acts as a Business Associate under HIPAA and handles that PHI under a separate Business Associate Agreement, not under this Policy. Individuals whose PHI is processed through the Service should contact the relevant operator (the Covered Entity) regarding their health-information rights.
1. Who We Are
FleetMark provides software that transportation operators ("Subscribers") use to dispatch, manage, and bill their fleet operations. Subscribers and their authorized users access the Service through accounts we provide. Some information described here relates to our Subscribers and their users; some relates to visitors to our websites.
2. Information We Collect
Account & contact information — name, business name, email address, phone number, and role, provided when an account is created or when you contact us.
Subscriber operational data — information Subscribers enter into the platform to run their operations (such as clients, passengers, trips, and invoices). For some Subscribers this may include PHI, which is governed by the Business Associate Agreement and the section above, not this Policy.
Usage & device data — log data, IP address, browser type, and similar technical information from our websites and app, including via cookies and similar technologies.
Payment information — processed by our payment provider (Stripe). FleetMark does not store full payment-card numbers.
3. How We Use Information
We use information to provide, operate, secure, support, and improve the Service; to authenticate users; to process billing; to communicate with you about your account and the Service; and to comply with legal obligations.
4. SMS / Text Messaging
The Service can send text messages (SMS/MMS) relating to transportation operations — for example, ride and dispatch notifications, status updates, scheduling information, and payment links — on behalf of Subscribers and to their authorized users and drivers.
Consent. We and our Subscribers send messages only to individuals who have provided consent to receive them, or where otherwise permitted by applicable law. By providing a mobile number to a Subscriber or to FleetMark in connection with the Service, you consent to receive operational text messages at that number.
No sale or sharing of mobile information. Mobile phone numbers and consent are used solely to deliver the messages described above. We do not sell mobile phone numbers, and we do not share them with third parties or affiliates for their own marketing purposes. Numbers are shared only with messaging-delivery providers (for example, Twilio) strictly to transmit the messages, and with no one else for marketing.
Message frequency varies based on operational activity (such as the number of rides or dispatches associated with you).
Message and data rates may apply depending on your mobile carrier and plan.
Opt out at any time by replying STOP to any message. You may reply HELP for assistance. After you reply STOP, you will receive a confirmation and no further operational messages, unless you opt back in.
Content. Operational text messages are limited to logistics information (such as date, time, and location). Identifying and sensitive details remain within the authenticated Service and are not included in text messages.

5. How We Share Information — Service Providers
We share information with service providers that help us operate the Service, under contract and only as needed to provide the Service:
Supabase — database and hosting
Vercel — application hosting
Twilio — SMS/text-message delivery
Stripe — payment processing
Where these providers handle PHI on our behalf, they do so under Business Associate Agreements. We do not sell personal information. We may disclose information if required by law or legal process, or in connection with a business transfer, subject to appropriate protections.
6. Data Security
We use administrative, physical, and technical safeguards designed to protect information, including encryption in transit and at rest, access controls, multi-factor authentication, tenant isolation, and audit logging. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
7. Data Retention
We retain information for as long as needed to provide the Service and as required by applicable law. Retention and return or destruction of PHI is governed by the Business Associate Agreement.
8. Your Rights
Depending on your jurisdiction, you may have rights to access, correct, delete, or port your personal information, and to opt out of certain processing. To exercise these rights, contact us using the information below. Rights relating to PHI are exercised through the relevant operator (the Covered Entity), as described above.
9. Cookies & Tracking
Our websites use cookies and similar technologies for functionality and analytics. You can control cookies through your browser settings.
10. Children
The Service is intended for businesses and is not directed to children under 16.
11. Changes to This Policy
We may update this Policy from time to time. Material changes will be indicated by updating the effective date and, where appropriate, by additional notice.
